Representative Matters

  • Defended and prosecuted preference, fraudulent transfer and other litigation in chapter 7, 11 and 13 cases on behalf of creditors and trustees
  • Represented creditors in contested stay relief and plan confirmation hearings, proof of claim litigation, avoidance actions, lender liability litigation, nondischargeability actions and loan workouts
  • Served as counsel for chapter 7, 11 and 13 debtors in individual and business cases and hearings regarding confirmation of chapter 11, 12 and 13 reorganization plans
  • Served as counsel to chapter 7 trustee in case involving the successful liquidation and sale of oil and gas company’s assets and averting multi-million dollar foreclosure
  • Represented clients in federal and state court appeals

  • Federal National Mortgage Association v. Hendricks, 463 Mass. 635 (Mass. 2012) (represented Real Estate Bar Association for Massachusetts, Inc. and The Abstract Club in writing amicus brief supporting plaintiff’s position in appeal pending before state supreme court; held: affidavit of sale in the form established by the legislature was sufficient; trial court’s decision in favor of plaintiff affirmed)
  • In re Dessources, 430 B.R. 330 (Bankr. D. Mass. 2010) (represented creditor in court’s decision finding a mortgage valid and enforceable over a debtor’s claims that the mortgage was avoidable on account of an acknowledgment where a blank for the evidence of identity in the form was not completed)
  • In re American Satellite & Entertainment, Inc., No. 07-10293 (Bankr. D.N.H.) (represented chapter 11 debtor with over $20 million in annual revenues at recent peak with obtaining confirmation of entity’s reorganization plan)
  • In re Woods, 316 B.R. 522 (Bankr. N.D. Ill. 2004) (represented chapter 13 debtor in successful motion to compel payment of postpetition tax claim by trustee)
